The cost of getting a dismissal ‘wrong’ can be considerable for an employer from a financial perspective.  Employees who win their claims can receive basic and compensatory awards as well as compensation for breach of contract, and a financial uplift for failure to follow the ACAS Code on disciplinary and grievance matters (if applicable).  Defending unfair dismissal claims can also be very time consuming, disruptive and lead to an employer suffering reputational damage.

The aim of the workshop is for delegates to gain an understanding of how to manage dismissals fairly.  Attendees will require to participate in practical case studies, which will focus on both the substantive and procedural aspects of dismissals.

The workshop will cover the following:

  • Meaning of dismissal
  • Legal framework for pursuing an unfair dismissal claim
  • Potentially fair reasons for dismissal: misconduct, capability (ill-health and poor performance), redundancy, statutory bar and some other substantial reason
  • Procedure that should be followed when carrying out a dismissal
  • Practical case studies

This course is specifically aimed at new HR recruits and companies that do not have a dedicated HR department.
