Scottish Engineering advises our members that the recent European Court of Justice decision in the Pereda case, Spain said workers who fall ill during their holiday can request to re-arrange the period of absence to another time.
The employer must allow them to take the equivalent time if they request it, and in some cases this may result in the leave being carried into the following holiday year. Due to this decision employers may wish to review their Absence Policy to include any arrangements on areas such as notification or evidence of illness.
